Pollard says PGA TOUR should show that a player’s participation in a LIV Golf event jeopardizes “confidential information or trade secrets, protected customer relationships, or an extraordinary investment in employee education or training.”
“These are the three biggest and most contentious legitimate commercial interests that would allow a court to enforce a non-compete agreement,” Pollard said. “And when you look at this situation with PGA TOUR, none of these interests are far from there.”
