Now that PGA TOUR has officially suspended seventeen players who agreed to take part in the LIV Golf event, some non-compete lawyers say a “big” antitrust lawsuit can be expected against TOUR.
“PGA TOUR is opening up to a really big lawsuit with possible antitrust allegations and also a situation where they can’t justify their actions other than by saying, ‘We don’t like competition,'” said John Lauro, a lawyer based in New York and Florida.

“And the courts are very concerned about why PGA TOUR is doing this,” Lauro continued. “The courts are now looking at these issues very carefully from an antitrust perspective. The courts are very skeptical about any trade restrictions and that would be part of what PGA TOUR is doing.”
And if you take a look at the memo issued to PGA TOUR members, they will certainly sound nervous about the competition offered by LIV Golf.
IAN POULTER CALLS FOR PGA TOUR FIGHT AGAINST LIVI GOLF LEAGUE, PLANNING TO APPEAL
PGA TOUR Commissioner Jay Monahan accuses LIV participants of “turning their backs on PGA TOUR”. He then becomes a little petty and tweaks them for not submitting proper papers: “As you know, the (LIV) players … did not receive the necessary controversial events and media rights publications – or did not request them at all.”
He also seems to appreciate players for wanting to play for money.
“These players have made their choice for their financial reasons,” Monahan said.

Apparently, Monahan thinks the PGA TOUR is a charity. But no. It is a well-funded company that has never had to compete for golfers or audiences before. Saudis and LIV Golf have changed all that.
According to Lauro and co-lawyer Jonathan Pollard, PGA TOUR is waiting for players to be suspended after the lawsuits and they have a hard time convincing the court that they had to do so to protect vital property interests.

Pollard says PGA TOUR should show that a player’s participation in a LIV Golf event jeopardizes “confidential information or trade secrets, protected customer relationships, or an extraordinary investment in employee education or training.”
“These are the three biggest and most contentious legitimate commercial interests that would allow a court to enforce a non-compete agreement,” Pollard said. “And when you look at this situation with PGA TOUR, none of these interests are far from there.”
Not to mention that stopping players just doesn’t make commercial sense.

“(PGA TOUR) has to give up its opposition to this,” Pollard predicts, “because no one wants to watch PGA TOUR if these top players don’t play. Then it hits their end result. enter into a transaction.
