WASHINGTON — Lawyers for former President Donald Trump are urging a federal appeals court to rule he cannot be prosecuted for allegedly instigating the 2021 United States Capitol riots because he has full immunity from such lawsuits.
As the Jan. 6 commission investigates his role in the Capitol attack and the Justice Department conducts an extensive criminal investigation, the former president’s attorneys are trying to protect him from civil lawsuits filed by Democratic members of Congress and two US Capitol Police officers who said they were injured during the siege.
U.S. District Judge Amit Mehta scaled back some of those claims in February, but declined to dismiss them all. Mehta ruled that Trump was not immune from civil lawsuits and that he was acting as a candidate and not performing any of the duties of his office when he spoke at a rally before the riot.
In a legal letter filed this week, Trump’s attorneys urged the U.S. Circuit Court of Appeals for the District of Columbia to find that the judge erroneously concluded that courts had not considered the content of a member’s comments. president should look when they decide whether immunity applies. “Examining the content of a tweet or speech constitutes a breach of executive power,” they said.
They relied heavily on a 1982 Supreme Court decision that dismissed a lawsuit against former President Richard Nixon by holding that presidents are immune from lawsuits over even actions on the “outer fringe” of their official duties. Trump’s speech before the riots falls into that category, his lawyers said.
By questioning the results of the election in the weeks leading up to January 6 and on the day itself, Trump exercised a president’s ability to use the bully’s pulpit and was “engaged in open discussion and debate about the integrity of the 2020 elections,” they said.
“The rioters’ actions do not deprive President Trump of his immunity,” she added.
Rejecting the same argument in February, Mehta said the rally speech was “similar to telling an excited crowd that corn merchants are starving the poor in front of the corn merchant’s house.” He said a later tweet in which Vice President Mike Pence was attacked during the attack suggested a “tacit agreement” with the rioters.
Trump’s actions “do not relate to his duties to faithfully execute the laws, direct foreign affairs, direct the armed forces, or direct the executive branch,” Mehta said. “They all relate to his efforts to remain in office for a second term. These are unofficial acts.”
House Democrats were the first to sue Trump. They said the Capitol riots were “the intended and foreseeable culmination of a carefully coordinated campaign to disrupt the legal process needed to confirm the count of votes cast in the Electoral College.”
Rep. Bennie Thompson, D-Miss., was originally the lead prosecutor, but he withdrew from the case after becoming chairman of the House committee investigating the riots. Ten House Democrats remain on the pack. Two other lawsuits were filed by Rep. Eric Swalwell, D-Calif., and the two police officers. Trump also faces five other civil lawsuits based on similar claims.
Trump’s lawyers have asked the appeals court to hear the oral hearing of their appeals. The plaintiffs have not yet responded.
